When things change, we need clients to complete a new form for processing their evictions. While the information below is on the HUD requirements for public housing and properties with project-based rental assistance (“PBRA”), the form needs to be completed by all clients on all evictions.
Again, the HUD requirement likely does not apply to most of our clients, but we need this information in our form. Here is the new AO form that we need all clients to complete:
The reason for this new form is because of the HUD requirement that public housing and properties with project-based rental assistance must:
  1. Give 30 day notice before terminating the lease.
  2. Owners must, at a minimum, use HUD-provided language, updated to reflect the entity issuing the notification with a link to the appropriate local ERA grantee and their contact information. See the Appendix: Information for Tenants in HUD’s October 7 notice. The appendix (page 9) is the actual form that HUD requires landlords to use and insert a link to the local ERA agency/grantee.
In addition to public housing, this applies to the following types of PBRA:
A. Section 8 Project Based Rental Assistance (PBRA)
1. New Construction
2. State Housing Agency Program
3. Substantial Rehabilitation
4. Section 202/8
5. Rural Housing Services Section 515/8
6. Loan Management Set-Aside (LMSA)
7. Property Disposition Set Aside (PDSA)
8. Rental Assistance Demonstration (RAD)
B. Section 202/162 Project Assistance Contract (PAC)
C. Section 202 Project Rental Assistance Contract (PRAC)
D. Section 202 Senior Preservation Rental Assistance Contract (SPRAC)
E. Section 811 Project Rental Assistance Contract
There is also an additional requirement for only public housing authorities – they must “inform all public housing tenants that the extended timeframe for notification of lease termination due to nonpayment of rent is in effect, and that families will be provided information on available funding in that 30-day notification.”
