NEW SQUATTER LAW

Question: I heard that there is a new law on squatters. Does this mean I can just throw someone out of my vacant house, if they are there?

Answer: Yes and no. We are happy to report that a new law addressing squatters was signed into law – however, that doesn’t mean you can simply throw someone out. The eviction laws were changed to address the situation of squatters, and it provides an expedited method to remove such a person. If you find someone has moved into a vacant unit, your first option should always be to call the police. However, if the police won’t remove the person as they have established residency, then you can use this new law to demand they leave, and follow the expedited eviction process. The writ is available immediately after the judgment is signed, instead of waiting the regular 5 day period. The Supreme Court is currently working on setting the procedures for how this new law will be handled in court.
