Question: I am going through an eviciton and the tenant turned in keys.Can I proceed with eh eviction.
Answer: It depends on where you are in the process.If the keys are turned in before the case is filed in court, then you must dismiss. Sometimes, this means you may even need to check with the court the exact time that the process server filed the case. If the tenant turns in keys before the case is filed, the case must be dismissed.AFTER the case is filed, then you can proceed to a judgment, even if the tenant turns in keys. Often times, we get calls from clients the day before court, letting us know that the tenant turned in keys because they think they can do so to avoid a judgment. This is not true - as long as the case was filed in court, it doesn't matter if the keys are later turned in. You can proceed and obtain a judgment.
